Acceptable Use Policy

Effective date: Sun, 01 January 2023

Important: This Acceptable Use Policy is tailored for Makuruwan Technologies (Private) Limited and is intended to be a strong publication-ready draft. It should still be reviewed by qualified legal counsel, especially where local telecom, privacy, cybersecurity, hosting, domain, anti-spam, or platform-specific obligations apply.

1. Purpose

This Acceptable Use Policy (“AUP”) describes rules governing use of the Makuruwan website, applications, platform, modules, APIs, infrastructure-linked services, and related offerings (collectively, the “Services”).

This AUP is intended to protect Makuruwan, its customers, resellers, users, client users, service providers, third parties, and the wider digital ecosystem from unlawful, harmful, abusive, insecure, deceptive, or operationally disruptive conduct.

2. General principle

You may use the Services only for lawful, authorized, good-faith business purposes consistent with these Terms, the nature of the Services, the rights of third parties, applicable law, and any service-specific instructions or restrictions we communicate.

If your use creates legal exposure, security risk, infrastructure instability, spam risk, harassment risk, domain abuse risk, hosting abuse risk, or reputational harm, it may violate this AUP even if the exact conduct is not listed word for word below.

3. You may not use the Services to:

  • violate any applicable law, regulation, or binding rule;
  • engage in fraud, impersonation, or deception;
  • infringe copyrights, trademarks, privacy rights, publicity rights, or other legal rights;
  • distribute malware, spyware, ransomware, malicious scripts, or other harmful code;
  • attempt unauthorized access to accounts, systems, APIs, databases, credentials, logs, or environments;
  • interfere with platform integrity, service availability, infrastructure health, or security controls;
  • scrape, probe, scan, benchmark, overload, or test systems without authorization;
  • conduct phishing, spam, scam activity, unsolicited bulk messaging, or abusive automation;
  • distribute unlawful, defamatory, threatening, abusive, hateful, exploitative, or fraudulent content;
  • facilitate surveillance abuse, stalking, credential theft, or other harmful digital conduct;
  • use the Services to support illegal products, illegal services, or unlawful business models; or
  • assist, encourage, or enable others to do any of the above.

4. Misrepresentation and deceptive conduct

You may not use the Services to impersonate another person, company, brand, registrar, service provider, or public authority.

You may not misrepresent the source, purpose, authenticity, authorization, affiliation, ownership, or legality of any communication, website, hosted asset, domain, CRM record, chatbot, sales message, or business operation conducted through the Services.

5. Security and platform integrity

You may not disable, bypass, undermine, reverse engineer, overload, interfere with, or compromise any authentication system, tenant boundary, client boundary, routing control, audit mechanism, logging mechanism, infrastructure control, billing control, or security-related part of the Services except to the extent such restriction is prohibited by law.

You must use appropriate internal security practices, including strong credential handling, access control discipline, and responsible administrative behavior.

6. Abuse of account structures and access

You may not create fraudulent accounts, duplicate accounts for evasion purposes, fake tenant structures, misleading client structures, or shadow users intended to conceal identity, avoid billing, evade suspension, or disguise abusive activity.

You may not transfer or resell account access in a manner not permitted by your plan, commercial agreement, or written authorization from Makuruwan.

7. CRM module acceptable use

When using the CRM module, you must not:

  • upload stolen, unlawfully obtained, or fabricated data;
  • use CRM data for harassment, unlawful profiling, or deceptive outreach;
  • process lead or customer data without appropriate lawful grounds, notice, or permission where required;
  • use CRM workflows to facilitate spam, fraud, intimidation, or unlawful marketing; or
  • store content that is unlawful, infringing, abusive, or materially misleading.

You are responsible for ensuring that the contacts, records, and workflows you maintain in CRM are legally and operationally appropriate.

8. WhatsApp chatbot builder acceptable use

When using the WhatsApp chatbot builder module, you must not:

  • send spam, scam, or deceptive messages;
  • message recipients without appropriate consent or lawful basis where required;
  • send abusive, threatening, discriminatory, or exploitative communications;
  • use the module to impersonate another person, business, or institution;
  • use automation to evade platform rules, consent controls, communication restrictions, or enforcement actions;
  • route unlawful campaigns, phishing messages, or high-risk content through the Services; or
  • violate Meta, WhatsApp, telecom, anti-spam, or messaging platform requirements applicable to your use case.

No platform enjoys being turned into a spam cannon, and neither do we.

9. Domain registration acceptable use

When using domain-related services, you must not:

  • attempt to register domains in bad faith or for unlawful impersonation;
  • submit false registrant information or misleading ownership details;
  • use domain services to support phishing, malware, fraud, impersonation, counterfeit activity, or illegal distribution;
  • attempt to misuse dispute procedures, verification processes, or transfer processes; or
  • knowingly register or use domain names in a way that violates third-party rights or applicable naming rules.

Makuruwan may suspend or refuse domain-related service activity where there is abuse risk, inaccurate data, verification failure, legal concern, or provider-driven restriction.

10. Hosting module acceptable use

When using hosting-related services, you must not host, distribute, execute, or facilitate:

  • malware, exploit kits, botnets, or harmful code;
  • phishing pages, scam content, or credential theft tools;
  • illegal content or unlawful business activity;
  • infrastructure abuse, denial-of-service activity, or traffic flooding;
  • unauthorized proxying, tunneling, scanning, or attack staging; or
  • content or software that creates unacceptable legal, operational, or reputational risk for Makuruwan or its service providers.

You are responsible for securing your hosted applications, access credentials, scripts, content, and integrations.

11. Communications and anti-spam standards

If the Services support communications, outreach, automation, reminders, or campaigns, you are responsible for compliance with all applicable consent, anti-spam, telecom, privacy, and marketing rules.

You must not use the Services for unsolicited bulk messaging, deceptive sender identity, harassment campaigns, mass spam, unlawful promotional activity, or communications likely to cause delivery blacklisting, provider enforcement, or systemic abuse complaints.

12. Monitoring, investigation, and enforcement

Makuruwan may investigate suspected violations of this AUP and may take appropriate action where risk, abuse, unlawful use, operational danger, or policy violations are suspected.

Such action may include:

  • warning notices,
  • restriction of particular features or modules,
  • suspension of accounts or services,
  • disabling of hosted content or automation flows,
  • blocking communications activity,
  • preservation of relevant records or evidence,
  • refusal of domain-related actions,
  • escalation to third-party providers, and
  • cooperation with legal authorities, regulators, or affected third parties where appropriate.

13. Reporting abuse or violations

If you become aware of misuse, abusive conduct, security concerns, phishing activity, spam activity, policy violations, or unlawful use of the Services, please report it promptly to:

compliance@makuruwan.com

14. Relationship to other documents

This AUP forms part of the broader legal framework governing the Services and should be read together with the Terms of Use, Privacy Policy, service-specific commercial terms, invoices, written agreements, and any operational policies communicated by Makuruwan.

15. Changes to this policy

Continued use of the Services after the updated AUP becomes effective may constitute acceptance of the revised policy, subject to applicable law.
